Tenant Protection Plan Service Notice

Beginning on June 22, 2020, an updated version of the TPP1: Tenant Protection Plan Form must be used and the associated Tenant Protection Plan Notice to Occupants must be distributed to occupied dwelling units and posted within the building when a permit is issued. The updated version of the TPP1: Tenant Protection Plan Form requires that the dwelling units that will be occupied during construction be identified with greater specificity, that the specific means and methods to be used for the limitation of noise to acceptable levels in accordance with the NYC Noise Control Code be identified, and that the Form be signed by the permit applicant and property owner. Previously, the Tenant Protection Plan Notice to Occupants had to be distributed to occupied dwelling units or posted within the building when a permit is issued. LL 106-2019 & 118-2019 modified the below section of the code to put the responsibility for the Tenant Protection Plan on a registered professional hired by the contractor. The Design professional no longer is required to prepare, sign and file the Tenant Protection Plan. The service notice and the new form does not make this clear.

28-104.8.4] § 28-120.1 Tenant protection plan. [Construction documents] A tenant protection

plan shall be prepared and submitted for the alteration[s], construction, or partial demolition of buildingsin which any dwelling unit will be occupied during construction [shall include a tenant protection plan],including newly constructed buildings that are partially occupied where work is ongoing. The tenantprotection plan shall be prepared by a registered design professional and filed with the department. Theregistered design professional preparing the tenant protection plan shall be retained by the generalcontractor performing the alteration, construction, or partial demolition work.
